These Terms of Service ("Terms") govern your access to and use of the Services provided by Feedloop Technologies ("Feedloop", "we", or "us"). By creating an account or using the Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Feedloop Services, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and accept these Terms in full. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. The Services
Feedloop provides a feedback and survey platform that allows you to embed survey widgets on your websites, collect user feedback, and analyse responses via our dashboard. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.
3. Accounts
You are responsible for:
- Providing accurate registration information and keeping it up to date
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access at [email protected]
You may not share account credentials with third parties or create accounts for purposes other than using the Services.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Collect data from individuals without their knowledge or appropriate consent
- Transmit malware, viruses, or other harmful code
- Attempt to gain unauthorised access to our systems or other users' accounts
- Use the Services for spam, phishing, or other deceptive practices
- Scrape, reverse-engineer, or create derivative works from the Services without our prior written consent
- Resell or sublicense access to the Services without our prior written consent
5. Your Content
You retain all intellectual property rights in the content you create, upload, or collect through the Services ("Your Content"). By using the Services, you grant Feedloop a limited, non-exclusive, royalty-free licence to host, store, process, and transmit Your Content solely as necessary to provide the Services.
You are solely responsible for ensuring Your Content complies with applicable laws, including data protection laws, and that you have obtained all necessary consents from survey respondents.
6. Billing and Payment
Paid plans are billed in advance on a monthly or annual basis. All fees are exclusive of applicable taxes. Failure to pay may result in suspension or termination of your account.
Refunds are issued at our sole discretion. If you believe you have been charged in error, contact us within 30 days of the charge at [email protected].
We reserve the right to change our pricing with 30 days' written notice. Continued use of the Services after the effective date of a price change constitutes acceptance of the new pricing.
7. Termination
You may close your account at any time from the account settings page. We may suspend or terminate your account immediately if we believe you have violated these Terms or pose a risk to us, other users, or third parties.
Upon termination, your access to the Services will cease and your data will be retained for 90 days before permanent deletion, in accordance with our Privacy Policy.
8. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, Feedloop's total liability to you for any claims arising from or related to the Services is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £100 GBP. In no event will we be liable for indirect, incidental, consequential, or punitive damages.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
